By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you must not access or use our Services.

Acceptance of Terms

By accessing or using Eventa’s Services:

You represent that you are at least 18 years old (or the legal age of majority in your jurisdiction) or that you have obtained parental or guardian consent to use the Services.
You affirm that you have the authority to enter into this agreement on behalf of yourself or any entity you represent.
You confirm that your use of the Services complies with all applicable laws and regulations in your jurisdiction.

If you do not meet these requirements, you may not access or use our Services. Your continued use of Eventa constitutes acceptance of these Terms

Changes to These Terms

Eventa reserves the right to modify these Terms at any time at its sole discretion. Any changes will become effective immediately upon posting the updated Terms on our platform. We may notify you of significant changes via email or within the app; however, it is your responsibility to review these Terms periodically. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms. Changes will never apply retroactively and will comply with consumer protection laws such as California’s Consumer Legal Remedies Act (CLRA) and EU Directive on Unfair Contract Terms.

Accessing the Services

We reserve the right to modify, suspend, or discontinue any part of Eventa’s Services without prior notice. While we strive to ensure uninterrupted access, we cannot guarantee that our platform will always be available or free from interruptions.

User Responsibilities:

By accessing Eventa's Services, you agree to:

Ensure that all individuals who access Eventa through your internet connection comply with these Terms.
Provide accurate and complete registration information when creating an account.
Use only authorized login credentials issued by Eventa to access restricted portions of our platform.

Account Security:

If we provide you with login credentials (e.g., username and password), you are solely responsible for maintaining their confidentiality. You agree to:

Notify us immediately if you suspect unauthorized access or misuse of your account.
Take reasonable precautions to secure your account from unauthorized access.

You acknowledge that any activity conducted under your account will be deemed as authorized by you unless proven otherwise. Eventa is not liable for any loss or damage resulting from unauthorized access due to your failure to safeguard your login credentials.

This section complies with cybersecurity standards such as GDPR Article 32 (Data Security) and California’s CCPA Section 1798.150(a).

Our Services

Eventa provides a platform that enables event organizers (“Organizers”) to create events, sell tickets, manage RSVPs, and facilitate event-related communications. Attendees (“Users”) can browse events, purchase tickets, RSVP for events, and engage with Organizers through our platform.

Service Provider Role: Eventa acts solely as an intermediary between Organizers and Users. We do not own, operate, or control any events listed on our platform. Accordingly:

Organizer Responsibility: Organizers are solely responsible for their events’ content, execution, ticketing policies (including refunds), and compliance with applicable laws.
No Guarantees: Eventa does not guarantee the availability, quality, safety, legality, or accuracy of any events listed on our platform.

This section aligns with intermediary liability protections under Section 230 of the U.S. Communications Decency Act and EU Directive on E-Commerce (Article 14).

Account Registration

To access certain features of Eventa’s Services:

Creating an Account: You must create an account by providing accurate and complete information during registration. You agree to update your account information as needed to ensure its accuracy.
Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
Prohibited Conduct: You may not create multiple accounts without prior written authorization from Eventa or provide false information during registration.

We reserve the right to suspend or terminate accounts that violate these Terms or provide inaccurate information.

This section complies with identity verification requirements under anti-fraud laws such as U.S. Computer Fraud and Abuse Act (CFAA).

Ticket Purchases and RSVPs

When purchasing tickets or RSVPing through Eventa:

Payments are processed by third-party providers (e.g., Stripe). By completing a transaction on Eventa, you agree to be bound by their terms.
Refunds are governed by each Organizer’s refund policy unless otherwise stated at the time of purchase.
Tickets purchased through Eventa may not be resold or transferred unless explicitly permitted by the Organizer.

Eventa is not liable for event cancellations, postponements, or other issues resulting from Organizer actions.
This section complies with PCI DSS standards for payment security and local refund regulations such as EU Consumer Rights Directive Article 16(c).

Fees and Taxes

You acknowledge that:

Eventa charges service fees for ticket sales and other transactions facilitated through our platform. These fees will be disclosed at checkout.
You are responsible for paying any applicable taxes associated with your purchases on our platform.

Service fees charged by Eventa are non-refundable unless otherwise required by law.

Compliant with local tax obligations like VAT; IRS in USA.

Prohibited Activities

You agree not to engage in any activity that:

Violates any applicable law or regulation.
Involves fraudulent practices (e.g., reselling tickets without authorization).
Introduces malware or harmful code into our platform.
Interferes with the functionality of our Services (e.g., using bots or automated tools).
Misrepresents your identity or affiliation with any person or organization.

Violation of this section may result in immediate account suspension or termination and potential legal action.

Aligned with CFAA/U.S.-EU Privacy Shield prohibitions against hacking/misuse.

Organizer Responsibilities

Organizers using Eventa’s Services agree to:

Provide accurate event details (e.g., date, location).
Obtain all necessary permits and licenses required for their events.
Honor all confirmed ticket purchases and RSVPs.
Comply with applicable laws governing their events (e.g., safety regulations).

Organizers are solely responsible for resolving disputes with Users related to their events.

User Contributions

Users may post content (e.g., reviews) on Eventa’s platform:

By posting content, you grant Eventa a non-exclusive license to use it for promotional purposes.
All content must comply with applicable laws and must not infringe upon third-party rights.
We reserve the right to remove content deemed inappropriate at our sole discretion.

You remain solely responsible for any content you post on our platform.

Privacy

Your use of Eventa is subject to our Privacy Policy, which explains how we collect, use, share, and protect your personal data in compliance with applicable privacy laws (e.g., GDPR in Europe; CCPA in California; PIPEDA in Canada).

Data Protection

While we take reasonable measures to protect your data:

We cannot guarantee absolute security due to inherent risks associated with online platforms.
In case of a data breach affecting your personal information, we will notify you as required by law.

Disclaimers

The Services are provided “as-is” without warranties of any kind:

We cannot guarantee absolute security due to inherent risks associated with online platforms.

Some jurisdictions do not allow certain warranty exclusions; therefore, some disclaimers may not apply to you.

Limitation of Liability

To the fullest extent permitted by law:

Eventa is not liable for indirect damages (e.g., loss of profits).
Our total liability will not exceed fees paid by you within six months prior to the claim.

This limitation does not apply where prohibited by law.

Indemnification

You agree to indemnify Eventa against claims arising from:

Your violation of these Terms.
Your misuse of our Services.
Any disputes between you and an Organizer or third party.

Dispute Resolution

For U.S.-based users: Disputes will be resolved through binding arbitration in New York under American Arbitration Association rules unless otherwise prohibited by law.
For international users: Local laws may apply where required by mandatory consumer protection rules.
Class action waivers apply unless prohibited by law.

Intellectual Property

All content on Eventa’s platform (logos, designs, text) is owned by us or licensed to us:

Unauthorized copying or distribution is strictly prohibited.
Violations may result in legal action.

Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in prohibited activities.

Upon termination:

Your license to use our Services ends immediately.
Certain provisions (e.g., indemnification) will survive termination as required by law.

Governing Law

These Terms are governed by New York law (for U.S.-based users) and Canadian provincial laws (for Canadian users), without regard to conflict-of-law principles.

International users may be subject to local consumer protection laws where applicable.
